Terms of Service

1. Who we are
Where we sailing? is operated by Where We Sailing, Inc., a company registered in California, the United States. We are a charter booking agent — we help you discover and book sailing charters offered by independent charter companies (“Operators”). We do not own, crew, or operate any vessel.
2. Our role — and the Operator’s
When you book, the charter contract is between you and the Operator. The Operator’s own terms, cancellation policy, and charter agreement govern the charter itself. We facilitate the connection, the booking, and the deposit collection described below; we are not a party to the charter contract and are not responsible for the vessel, its condition, the crew, or the conduct of the charter.
3. Bookings & the deposit
To reserve a boat, you and your crew pay a deposit, split across your group, through Where we sailing? using our third-party payment processor. We collect the deposit as agent for the Operator to secure your booking. The boat is only held once every crew member’s share is received. The balance of the charter fee, and any security deposit, are paid to or held by the Operator under the Operator’s payment terms. A booking is confirmed only once the Operator confirms availability.
4. Prices, extras & currency
Prices are shown per person, per night, and are estimates for the selected week; they may change until a booking is confirmed. They may exclude items such as the security deposit, APA (provisioning/fuel), end cleaning, tourist taxes, and optional extras. Final amounts, inclusions, and currency are set by the Operator and shown before you complete your booking and in the Operator’s booking documents.
5. Cancellations & refunds
Cancellations and refunds are governed by the Operator’s policy for your booking. See our Cancellation & Refunds page for how this works and how the deposit is handled.
6. Your responsibilities
- Provide accurate booking and guest information.
- Hold any sailing qualifications the Operator requires (e.g. a skipper licence for a bareboat charter), or arrange a professional skipper.
- Comply with the Operator’s charter agreement, local laws, and safe-boating practices.
7. Intellectual property
The Where we sailing? site, its design, text, and all imagery — including our AI-generated vessel illustrations — are owned by Where We Sailing, Inc. or our licensors and are protected by copyright and other laws. You may not copy, scrape, reproduce, or reuse them without our written permission.
8. Disclaimers
The service is provided “as is.” We do not warrant that listings, availability, pricing, or Operator information are complete or error-free, and we are not liable for the acts or omissions of any Operator.
9. Limitation of liability
To the maximum extent permitted by law, Where We Sailing, Inc. is not liable for indirect, incidental, or consequential damages, or for any loss arising from the charter itself, which is the Operator’s responsibility. [Liability cap / carve-outs — counsel to set.]
10. Indemnification
You agree to indemnify Where We Sailing, Inc. against claims arising from your use of the service or your charter, except to the extent caused by our own fault.
11. Governing law & disputes
These terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws rules. [Venue / arbitration clause — counsel to set.]
